Camping Gear Rental Conditions

This Rental contract is entered into between Explora and the Renter (collectively the “Parties”) and outlines the respective rights and obligations of the Parties relating to the rental of the equipment. By confirming this booking, you are accepting the rental conditions explained below. 

All prices mention below include GST and are given in Australian Dollars. 

  • Rental term

The term of this Rental runs from the date and hour of pickup as indicated in this booking confirmation until the return to Explora, and completion of all terms of this agreement by both Parties. The estimated rental term is according to the booking made. 

The Parties may shorten or extend the estimate term of rental by mutual consent. If the renter wants to modify the rental term, must inform a Explora team member about their intention with 4 days’ notice. There is no guarantee the Rental gear will be available for extension. 

  • Scope of use

Renter will use the Rented equipment only for personal and leisure use and operate the Rented equipment only on properly maintained sites. Renter will not sublease the Rental equipment or use it as a gear for hire. Renter will not take the gear out of Tasmania.

  • Camping gear

From the rental start, the risk in the Items in the camping gear passes to you and remains with you until its Return. In the event that Items go missing or are Delivered to the incorrect address after pickup, you agree to comply with instructions from Explora to replace the Items. Explora accepts no liability for Items lost or damaged between pickup and Return.

Items must be return in a clean and tidy state (and otherwise in the same condition as when they were given to you). This doesn’t apply to sleeping bags, pillow covers, blankets or bedsheets. 

Camping Gear Conditions

Any missing or broken item will be charge according to the rental fees, with a maximum of $300 per item, where the item will be replaced, and the receipt will be sent to the Renter and a refund of the exceed payment will be made. 

The Renter:

  • agrees with the full camping gear list given by Explora and confirm their good condition, pictures before signing the agreement can be taken as proof of condition and must be shown to a Explora staff member for confirmation. 
  • must only use the Items for their intended purpose.
  • must notify Explora of any damage to, or issues with, the Items as soon as possible upon pick up of the Items and record evidence of such damage, including photographs (failing which, such damage or issues will be deemed to have been caused by you)
  • warrant that you know how to safely and properly use all Items and agree that you will use and treat all Items in accordance with such standards.
  • must not use the items for any purpose that is illegal, beyond its intended use, or otherwise prohibited by these Terms.

  • Bond

Please note a bond of $400 is requested when picking up the gear; this is to cover the damage or any broken items. If no damage occurs, the amount will be fully returned when dropping off the equipment.

  • Indemnification

Renter agrees to indemnify, defend, and hold harmless Explora for any loss, damage, or legal actions against Explora as a result of Renter’s operation or use of the Rented equipment during the term of this Rental Agreement. This includes any attorney fees necessarily incurred for these purposes. 

  • Representations and warranties

Owner represents and warrants that to Owner’s knowledge, the Rental Vehicle is in good condition and is safe for ordinary operation of the vehicle. 

Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal manner.

Renter has been given an opportunity to examine the Rental Vehicle in advance of taking possession of it, and upon such inspection, is not aware of any damage existing on the vehicle other than that notated by separate Existing Damage document.

Owner represents and warrants that to Owner’s knowledge, the Rental Vehicle is in good condition and is safe for ordinary operation of the vehicle. 

Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal manner.

Explora represents and warrants that to Explora’s knowledge, the Rental equipment is in good condition and is safe for ordinary operation of the gear.

Renter has been given an opportunity to examine the Rental equipment in advance of taking possession of it, and upon such inspection, is not aware of any damage existing on the gear other than that notated by separate Existing Damage document.

  • Jurisdiction and venue

In the event of any dispute over this agreement, this Rental Agreement will be interpreted by the laws of Tasmania, Australia, and any lawsuit or arbitration must be brought in the corresponding region of Tasmania, Australia. If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.

  • Entire agreement 

This Rental Agreement constitutes the entire agreement between the Parties with respect to this rental arrangement. No modification to this agreement can be made unless in writing signed by both Parties. Any notice required to be given to the other party will be made to the contact information below.
